WhatsApp Terms of Service
These WhatsApp Terms of Service ("Terms") govern your communication with Birdcage33 Tur. Tic. Ltd. Şti. ("Birdcage33", "we", "us", or "our") through the WhatsApp Messenger platform. By initiating a conversation with us on WhatsApp, you agree to these Terms together with our WhatsApp Privacy Policy. If you do not agree, please do not use WhatsApp to contact us.
1. About the Service
We use WhatsApp as one of several channels for communicating with current and prospective customers. Through WhatsApp you may, among other things, ask questions about our products and services, request information or quotes, place or modify reservations or orders, receive operational notifications, and provide feedback.
WhatsApp is operated by WhatsApp Ireland Limited and Meta Platforms, Inc., not by Birdcage33. Your use of WhatsApp itself is subject to WhatsApp's own terms, available at https://www.whatsapp.com/legal/.
2. Eligibility
You must be at least 16 years old (or the minimum age required by WhatsApp's own terms in your country, whichever is higher) and legally able to enter into a binding agreement to communicate with us through WhatsApp. By messaging us, you represent that you meet these requirements.
3. Acceptable Use
When you communicate with us through WhatsApp, you agree not to:
- Send unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable content.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
- Send spam, chain messages, unsolicited promotional content, or content that infringes intellectual-property or privacy rights.
- Send malware, viruses, or any code intended to disrupt or compromise our systems.
- Attempt to access conversations, accounts, or data that do not belong to you.
- Use the service in any way that violates WhatsApp's terms, Meta's commerce or business policies, or any applicable law or regulation.
We reserve the right to refuse service, block, or report any user who violates these Terms.
4. Operating Hours and Response Times
We make reasonable efforts to respond to messages during our normal business hours. We do not guarantee that messages will be answered immediately or at any specific time. WhatsApp messages are not appropriate for emergencies or time-critical safety issues.
5. Reservations, Orders, and Other Transactions
Any reservation, order, quotation, or commitment discussed through WhatsApp is provisional until it is confirmed by us in writing (including by a confirmation message clearly stating that the booking or order is accepted). We may, at our discretion, decline or cancel any request that we are unable to fulfil, that contains errors, or that conflicts with our policies.
Pricing, availability, and product descriptions provided over WhatsApp are indicative and may be updated without notice. The final terms applicable to any sale, reservation, or service are those set out in the corresponding written confirmation, invoice, or contract.
6. Promotional Messages and Opt-Out
We will only send you promotional or marketing messages over WhatsApp if you have given us prior consent. You can opt out at any time by replying "STOP" to the relevant message or by emailing info@birdcage33.com. Operational and transactional messages directly related to a request you initiated are not considered marketing.
7. Intellectual Property
All content we send through WhatsApp — including text, images, logos, brochures, menus, and other materials — is owned by Birdcage33 or its licensors and is protected by intellectual-property laws. You may use such content for your personal, non-commercial reference only and may not copy, modify, distribute, or create derivative works without our prior written consent.
By sending us content through WhatsApp (for example, photos or feedback), you grant us a non-exclusive, royalty-free, worldwide licence to use that content solely for the purpose of responding to you and operating our business. You confirm that you have the necessary rights to share such content.
8. Privacy
Our processing of personal data exchanged on WhatsApp is described in our WhatsApp Privacy Policy. Please review it carefully. By using WhatsApp to contact us, you acknowledge that messages will also be processed by WhatsApp / Meta in accordance with their own policies.
9. Disclaimer of Warranties
To the maximum extent permitted by applicable law, communications over WhatsApp are provided on an "as is" and "as available" basis. We do not warrant that the WhatsApp service will be uninterrupted, error-free, secure, or free of viruses or other harmful components, as the underlying platform is operated by a third party.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Birdcage33 shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or in connection with your use of WhatsApp to communicate with us, including any failure, delay, or compromise of the WhatsApp service. Nothing in these Terms limits liability that cannot be excluded under mandatory Turkish law.
11. Indemnification
You agree to indemnify and hold harmless Birdcage33 and its directors, employees, and affiliates from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of WhatsApp, or your violation of any law or third-party right in connection with our communications.
12. Suspension and Termination
We may, at our discretion and without prior notice, refuse to respond to, block, or report any WhatsApp contact who violates these Terms or whom we reasonably suspect of fraudulent, abusive, or unlawful activity. You may stop using WhatsApp to contact us at any time.
13. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date and will apply to all communications taking place after that date. If you continue to communicate with us on WhatsApp after the changes are posted, you accept the updated Terms.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-laws principles. The courts and enforcement offices of Bodrum, Muğla shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms, without prejudice to mandatory consumer-protection rules that grant consumers the right to bring proceedings in their place of residence.
